What is a payment in lieu of notice?

A payment in lieu of notice is often used where there is little value to either the employer or employee in the employee working their notice and therefore an immediate stop to the employment may be appropriate and their notice paid to them in one lump sum, usually on the day of termination. It is particularly common in redundancy cases.

The general rule is that a contract of employment can be terminated by either side giving the appropriate (contractual) notice to the other party. This notice is generally set out in the contract of employment. Terminating the contract without the appropriate notice would be a breach of contract and could lead to a claim for damages. Therefore, at it's most basic level, a payment in lieu of notice (PILON) is made by the employer to cover damages for the 'breach of contract' involved in terminating the contract without giving proper notice.

NB. It is therefore important to avoid claims of breach of contract for PILON that your contracts of employment include a clause specifically allowing you to make a PILON. If this is present, there can be no claim for damages relating to this payment method.

You should always take advice before paying an employment in lieu of notice. Message me if you'd like more information on this or any other HR matters.

In the 2010 Spending Review, the Coalition set out a programme of savings to be made throughout Government, including the renegotiation of contracts with major suppliers. With greater scrutiny of procurement spending and with rising Government and citizen demand for more agile, risk-averse, responsive and customer-focused service provision, it is becoming increasingly important for the public sector to challenge the assumption that ‘big is best’ when it comes to procurement contracting. Instead, it’s time that the public sector considers new and better ways of purchasing goods and services from SMEs.

 

As the Chair of the SME Action Group for Thames Valley Berkshire Local Enterprise Partnership, I was keen to work with Berkshire Unitary Authorities to look at how we can create a target percentage improvement of spend with local businesses.  As part of this process I worked with Rafiq Chohan, managing director of Slough-based SME recruitment business,Goldteam, and together talked to the Chief Executives of each of the six Unitary Authorities in Berkshire to understand how local government procures and where in the supply chain an SME might be able to access opportunities.

Online video advertising. I have been online for over a decade, seen and done many things online but "Business Biscotti" now has Infogurushop blogging for it. My reasons for this is, I love the way Biscotti makes it simple to network with a SMILE. This is different to the many other local, national and global competitors such as BNI, Xing, Linkedin and even Twitter, which I must confess I am a Twitaholic. Business Biscotti seems to just work! They make 'networking' in the UK friendly, happy, exciting and no pressure with 'Real People' and great social technology. So my contribution to the community will be keeping them informed about Online Video Advertising. If you read my online profile video advertising + SEO + Social Media with even your own voicemail is my specialty. I am no stranger to Google knowledge. And for those who do not yet know.......ONLINE VIDEO is now the Gold Rush of the Internet. If you don't believe it just watch videos and news on http://www.infogurushop.com or YouTube. 

I am hoping the Biscotti community will arise to becoming the #1 networking community in the UK. I will certainly play my part. I am not plugging my website for no reason - like Biscotti is power-packed and updated daily IGS is full of global video business information to help any business, brand, product or service become successful online or offline. Another great information source is my Scoop IT link. I am a firm believer that effective Business networking is demonstrating what you can do to showcase others.

I worked with the artist Jamie Treadwell over a period of six months, recording in stills photographs his creation of a new painting on canvas. Here is the result, a stills video set to music by composer Sveinung Nygaard; it's called"Images of a Creative Process". Perhaps art and business have much in common and ideas worth sharing?
